Copyright Policy

1. About This Policy

DMCA+ is software operated by Ruby Dev SRL that website owners use to receive and handle copyright takedown notices under the Digital Millennium Copyright Act ("DMCA"). We do not host the content reported in those notices. It is on our customers' websites, and each customer decides how to respond. This policy explains how notices sent through DMCA+ are handled.

2. Sending a Notice

To report content on a website that uses DMCA+, send your notice to that website's DMCA notice address or use the notice form on the website. Under 17 U.S.C. § 512(c)(3), a valid notice must include:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to be infringed
• Identification of the material claimed to be infringing, with enough information to locate it, such as its URL
• Your contact information, such as your address, telephone number, and email address
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice may be liable for damages.

3. What Happens After a Notice Is Received

• The notice is logged in the website owner's DMCA+ account, and the website owner is notified by email.
• DMCA+ extracts the reported URLs and matches them to the website owner's websites.
• The website owner reviews the notice and decides whether to remove the material, reply, or send a counter-notification. Replies come from the website's DMCA+ notice address.
• Every notice and response is kept on record in the website owner's account.

4. Counter-Notifications

If material was removed because of a mistake or misidentification, the person who posted it may send a counter-notification. Under 17 U.S.C. § 512(g)(3), a valid counter-notification must include:

• A physical or electronic signature of the sender
• Identification of the material that was removed and the location where it appeared before removal
• A statement under penalty of perjury that the sender has a good faith belief that the material was removed as a result of mistake or misidentification
• The sender's name, address, and telephone number
• A statement consenting to the jurisdiction of the Federal District Court for the judicial district of the sender's address or, if the address is outside the United States, any judicial district in which the service provider may be found
• A statement that the sender will accept service of process from the person who provided the original notice, or their agent

DMCA+ can prepare a draft counter-notification, but it is sent by the website owner under their own name, and they are responsible for its accuracy.

5. Website Owner Responsibilities

• Website owners are responsible for the content on their websites and for responding promptly to valid notices.
• Website owners must keep their contact details and notice address up to date.
• Website owners are responsible for adopting and enforcing their own repeat infringer policy, as the DMCA safe harbor requires.

6. Designated Agent

DMCA+ does not act as a designated agent and does not register agents with the U.S. Copyright Office. Each website owner is responsible for designating and registering their own agent. Website owners may list their DMCA+ notice address as the agent's email so that notices arrive in DMCA+.

7. Misuse of DMCA+

We may suspend or close a DMCA+ account that is used to send notices, replies, or counter-notifications that the account holder knows to be false.
